These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and SE Gains LLC ("SE Gains LLC," "SE Gains," "we," "us," or "our") governing your access to and use of our website, applications, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

If you are using the Service on behalf of a company, organization, or other entity, you represent that you have the authority to bind that entity to these Terms, and "you" refers to that entity.

SE Gains provides an AI-powered content generation platform that helps users create SEO-optimized articles, images, and related content for their websites. The Service includes features such as article generation, image creation, keyword research, content scheduling, and website integrations.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You must be at least 18 years of age to create an account. We reserve the right to suspend or terminate accounts that violate these Terms.

The Service offers both free and paid subscription plans. By selecting a paid plan, you agree to pay all applicable fees.

Billing: Paid subscriptions are billed in advance on a recurring basis (monthly or annually) depending on your selected billing cycle. All payments are processed through our payment processor, Paddle.

Automatic Renewal: Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings.

Credits: Monthly credits included with your plan reset every 30 days. Unused monthly credits do not roll over. Topup Credits purchased separately remain available for one year from the date of purchase.

Taxes: All fees are exclusive of applicable taxes. You are responsible for any taxes associated with your use of the Service.

You retain ownership of any content you submit to the Service ("User Content"). By submitting User Content, you grant SE Gains a limited, non-exclusive license to use, process, and display your content solely for the purpose of providing the Service to you.

You represent and warrant that you have all necessary rights, licenses, and permissions to submit your User Content and that it does not violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights.

We do not claim ownership of any content generated through the Service using your inputs. You are responsible for reviewing all generated content before use.

The Service uses artificial intelligence to generate content. You acknowledge and agree that:

• AI-generated content may not always be accurate, complete, or suitable for your intended use
• You are solely responsible for reviewing, editing, and verifying all generated content before publishing or relying on it
• SE Gains makes no guarantees regarding the accuracy, originality, or SEO performance of generated content
• Generated content should not be used as a substitute for professional advice in regulated industries (medical, legal, financial, etc.)

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Infringe upon or violate the intellectual property rights or any other rights of third parties
• Transmit any viruses, malware, or other harmful code
• Attempt to gain unauthorized access to the Service or its related systems
• Use the Service to spam, send unsolicited communications, or engage in phishing
• Violate any applicable local, state, national, or international law or regulation
• Resell, distribute, or share your account access with others without authorization

The Service and its original content, features, functionality, and design are owned by SE Gains and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our express written permission.

The Service may contain links to or integrations with third-party websites or services that are not owned or controlled by SE Gains. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

Your use of third-party services is at your own risk, and you should review their terms and policies before engaging with them.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that the results obtained from the use of the Service will be accurate or reliable.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SE GAINS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID TO SE GAINS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

You agree to defend, indemnify, and hold harmless SE Gains and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, and settlements, including reasonable legal and accounting fees, arising from or related to your violation of these Terms or your use of the Service.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by contacting us or through your account settings.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved in the competent courts of the applicable jurisdiction.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised Terms.
